1. About These Terms

These Terms and Conditions (“Terms”) apply to your download, installation and use of the ChoreForge mobile application (“ChoreForge” or “the App”).

ChoreForge is developed and operated by Hearth & Hero Studio (“we”, “us” or “our”).

The App is designed for use by families. An adult parent or legal guardian creates and manages the family account, while child profiles may use the child facing features of the App under that adult’s supervision.

By creating an account or using ChoreForge, you agree to these Terms.

If you do not agree to these Terms, you should not use the App.

2. Adult Accounts and Children’s Use

A ChoreForge adult account must be created and managed by a person aged 18 or over.

Children do not create independent ChoreForge accounts. A child profile exists within a family group established and managed by an adult account holder.

By creating a child profile or allowing a child to use ChoreForge, you confirm that you are authorised to do so and accept responsibility for managing that child’s access to the App.

Parents and guardians are responsible for:

  • keeping their account credentials secure;
  • keeping their Family Code and other family access information appropriately protected;
  • deciding which children and other permitted family members may access their family group;
  • creating and managing chores, quests and rewards;
  • supervising their child’s use of the App where appropriate; and
  • ensuring information entered into the App is suitable for the family members who will see it.

You should contact us promptly if you believe your account or Family Code has been accessed without permission.

3. What ChoreForge Provides

ChoreForge is a household organisation and gamification tool intended to help families encourage chores, responsibilities and positive habits.

Features may include:

  • assigning chores and quests;
  • recording completed tasks;
  • earning XP;
  • earning virtual coins;
  • tracking progress and achievements; and
  • recording or managing household rewards.

ChoreForge does not provide financial, banking, payment or money transfer services.

4. Virtual Coins, XP and Rewards

Any coins, XP, points, levels, achievements or similar balances displayed within ChoreForge are virtual values used only within the App.

They are not money.

They:

  • have no cash or monetary value;
  • cannot be withdrawn as cash from ChoreForge;
  • are not stored funds or electronic money;
  • do not represent a bank balance;
  • cannot be transferred outside the App as currency; and
  • do not create a financial obligation on Hearth & Hero Studio.

Parents may choose to associate virtual ChoreForge coins or achievements with real world rewards such as pocket money, treats, activities, screen time or other household privileges.

Any such arrangement is a private agreement between family members and takes place outside ChoreForge.

Hearth & Hero Studio is not responsible for deciding, providing, purchasing or fulfilling those real world rewards, or for resolving disagreements between family members about them.

5. Family Content and Information You Enter

Parents and family members may be able to enter information such as names or nicknames, chores, quest descriptions, reward descriptions and other household information.

You remain responsible for information you enter into ChoreForge.

You should not use ChoreForge to enter content that:

  • is unlawful;
  • is abusive, threatening or deliberately harmful;
  • infringes another person’s intellectual property or privacy rights;
  • contains unnecessary sensitive personal information; or
  • is otherwise inappropriate for a family oriented service.

You retain ownership of content you create.

You give us permission to process, store and display that content only to the extent reasonably necessary to operate ChoreForge and provide its features to your family group.

Our handling of personal information is explained in the ChoreForge Privacy Policy.

6. Advertising

The child facing areas of ChoreForge do not display advertising.

Parent facing areas of ChoreForge may contain advertising.

This may include banner advertising or optional rewarded advertising features intended for adults.

We do not use a child’s ChoreForge activity, chores, XP, virtual coin balance or reward history to target advertising at that child.

Further information about advertising and the processing of personal information is contained in our Privacy Policy.

7. Third Party Services

ChoreForge relies on third party services to provide some of its functionality.

These may include services provided by Google, including:

  • Firebase Authentication;
  • Cloud Firestore;
  • Firebase infrastructure;
  • Google Sign In;
  • Google Analytics for Firebase; and
  • Google Play services.

Third party services may occasionally experience outages, technical problems or changes that are outside our reasonable control.

Where a third party service has its own terms or privacy policy, your use of that service may also be subject to those terms.

Nothing in this section affects any rights you may have against Hearth & Hero Studio under applicable law.

8. App Stores

If you download ChoreForge through an app store such as Google Play, your use of that app store is also subject to the app store provider’s applicable terms and conditions.

The app store provider is not responsible for these Terms between you and Hearth & Hero Studio except where its own terms or applicable law state otherwise.

9. Intellectual Property

ChoreForge and its original content are owned by Hearth & Hero Studio or used by us under appropriate licence.

This includes, where applicable:

  • source code;
  • software;
  • artwork;
  • graphics;
  • user interface designs;
  • characters;
  • logos;
  • branding;
  • written content;
  • sound and music; and
  • other original creative assets.

These Terms do not transfer ownership of our intellectual property to you.

You may use ChoreForge for its intended personal and household purposes.

Except where permitted by law, you must not:

  • copy or redistribute substantial parts of the App;
  • modify or create unauthorised derivative versions of the App;
  • attempt to gain unauthorised access to ChoreForge systems;
  • circumvent security measures;
  • use our branding or artwork without permission; or
  • reverse engineer, decompile or attempt to extract source code where doing so is prohibited by law.

Nothing in these Terms prevents anything that applicable law expressly permits us from preventing by contract.

10. Acceptable Use

You must not misuse ChoreForge.

In particular, you must not knowingly:

  • interfere with the operation or security of the App;
  • attempt to access another family’s information without permission;
  • impersonate another person;
  • submit malicious software or harmful code;
  • attempt to circumvent authentication or security systems;
  • use automated tools to overload or disrupt the service;
  • use the App for unlawful purposes; or
  • encourage another person to do any of these things.

11. Suspension and Termination

You may stop using ChoreForge at any time.

Where available, you may also delete your account through the App or contact us for assistance.

We may restrict, suspend or terminate access to ChoreForge where we reasonably believe this is necessary because:

  • these Terms have been seriously or repeatedly breached;
  • an account is being used unlawfully;
  • another person or family may be at risk;
  • the security or integrity of ChoreForge is threatened;
  • we are required to do so by law; or
  • the service is being deliberately misused.

Where reasonably practical and appropriate, we will provide notice before taking action.

In urgent security, safety, legal or abuse situations, immediate action may be necessary.

Termination does not affect rights or obligations that arose before termination.

12. Changes and Updates to ChoreForge

We may update ChoreForge from time to time.

Updates may include:

  • new features;
  • improvements;
  • bug fixes;
  • security updates;
  • compatibility changes; or
  • changes to existing features.

Because ChoreForge is an evolving digital service, individual features may change over time.

We may also discontinue a feature or, where reasonably necessary, discontinue the App.

Where a significant change is likely to materially affect users, we will take reasonable steps to provide appropriate notice where practical.

Nothing in this section removes any statutory rights you may have in relation to digital content.

13. Changes to These Terms

We may update these Terms when necessary, for example because:

  • ChoreForge gains new features;
  • our business or technology changes;
  • legal or regulatory requirements change; or
  • we need to clarify how the service operates.

The latest version will be made available on our website and will display its effective or “Last Updated” date.

Where a change materially affects your rights or obligations, we will take reasonable steps to bring it to your attention.

Your continued use of ChoreForge after updated Terms take effect will mean that your continued use is subject to the updated Terms.

If you do not agree with an updated version, you may stop using ChoreForge and close your account.

14. Availability of the Service

We aim to keep ChoreForge available and functioning reliably, but internet based services cannot be guaranteed to operate continuously without interruption.

Availability may occasionally be affected by:

  • maintenance;
  • software updates;
  • internet or network problems;
  • third party service outages;
  • device compatibility;
  • security incidents; or
  • circumstances outside our reasonable control.

Where reasonably possible, we will attempt to restore affected services.

15. Your Consumer Rights

Nothing in these Terms excludes, restricts or limits any rights you have under applicable consumer law that cannot lawfully be excluded or restricted.

Where UK consumer law applies, digital content may be subject to statutory requirements and remedies.

These Terms are intended to operate alongside those rights, not replace them.

16. Our Responsibility to You

We are responsible for losses you suffer where they are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable when you began using ChoreForge.

ChoreForge is designed for personal and household use. We are not responsible for business losses such as loss of profits, revenue, business opportunity or commercial interruption arising from consumer use of the App.

We are not responsible for disagreements between family members concerning:

  • whether a chore was completed;
  • the award or removal of virtual coins or XP;
  • parental decisions regarding rewards;
  • pocket money;
  • screen time;
  • household privileges; or
  • other family arrangements made outside the App.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any statutory consumer right or other liability that cannot legally be excluded.

17. Privacy and Children’s Data

Your privacy and the privacy of children using ChoreForge are important to us.

Our collection, use, storage and protection of personal information is explained separately in the ChoreForge Privacy Policy, available at:

https://www.hearthandhero.com/choreforge/privacy/

Parents and guardians should read that Privacy Policy before creating or managing child profiles.

18. Severability

If any part of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

Where possible, the affected provision will be treated as modified only to the extent necessary for it to remain lawful and enforceable.

19. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean we have waived our right to enforce it later.

20. Governing Law and Disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in these Terms deprives you of any mandatory protections provided by the law applicable to you.

If you live in England or Wales, proceedings relating to these Terms may be brought in the courts of England and Wales.

If you live elsewhere in the United Kingdom, you may also have the right to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.

We encourage users to contact us first if a problem arises so that we have an opportunity to resolve it.
